Contract Management

Pre-Contract

  1. Provide sound and practical commercial advice on key contract terms, including payment milestones, liquidated damages, bank guarantees, and insurance requirements.
  2. Review and validate commercial assumptions and cost components such as warranties, risk contingencies, site preliminaries, labour costs, and insurance provisions.
  3. Lead commercial reviews of bids and contracts across various project models (e.g., EPC, O&M, BOT, DBOO).
  4. Drive commercial input into bids, proposals, and offer approval processes.
  5. Identify, assess, and mitigate contractual risks during the bidding stage.

Post-Contract

  1. Manage end-to-end contract administration, including:
  2. Bonds, insurances, and guarantees
  3. Billing triggers and alignment of payment milestones
  4. Contract notices and preservation of contractual entitlements
  5. Completion certificates and project close-out documentation
  6. Lead the preparation, evaluation, and negotiation of Extension of Time (EOT), variation orders, and commercial settlements.
  7. Ensure strong contract discipline by:
  8. Maintaining accurate and audit-ready documentation
  9. Ensuring data accuracy in systems (e.g., SAP: billing plans, forecast completion dates)
  10. Managing contract flow-down requirements to suppliers and subcontractors
  11. Act as the escalation point for commercial and contractual disputes involving clients, vendors, and subcontractors.

Commercial Governance & Controls

Pre-Contract

  1. Ensure compliance with internal governance frameworks for proposal approvals and escalation thresholds.
  2. Enforce adherence to policies related to order booking, bonds, and guarantees.

Post-Contract

  1. Oversee project financial performance, including:
  2. Monitoring Estimate at Completion (EAC) accuracy and cost trends
  3. Conducting risk quantification and mitigation planning
  4. Drive project close-out activities, including final account settlement.
  5. Ensure timely review and approval of EAC and related financial controls.
  6. Lead initiatives to mitigate risks and improve overall project profitability.

Requirements

  1. Bachelor's or Master's degree in Engineering, Business, Quantity Surveying, or a related discipline.
  2. 5-10 years of progressive experience in contract and commercial management.
  3. Prior experience in EPC, water, infrastructure, or related industries is preferred.
  4. Demonstrated success in contract negotiation, claims management, and commercial dispute resolution.
  5. Mandarin language proficiency (spoken and written) is an advantage.
  6. Professional certifications in contract, commercial, or project management (e.g., PMP, CCP, CIPS, or equivalent) are an added advantage.
