JOB SUMMARY
Responsible for managing and advising on all litigation and dispute resolution matters involving the organisation. The role includes analysing and approving investigation papers for legal action, attending court proceedings (including trials both prosecution and civil matters), conducting extensive legal research and providing legal opinions encompassing wide spectrum of laws including insolvency, contractual, commercial, investment, property, land matters disputes. Additionally, the role involves managing and liasing with external counsel, including formulating case strategies, reviewing and approving settlement.
JOB DESCRIPTION
LITIGATION & PROSECUTION
- Analyse and evaluate investigation papers submitted by enforcement officers for the purpose of initiating legal action, including both prosecution and civil proceedings.
- Conduct and manage cases, including attending court proceedings and trials for prosecution actions undertaken by the Board against employers and other individuals for offences under the relevant legislation.
- Attend and handle civil proceedings (which are handled internally) at all levels of courts including both contested and non-contested matters.
- Conduct legal research and provide well-reasoned legal opinions to internal and external stakeholders.
- Provide legal advisory services to internal departments/ branches on both contribution and non-contribution matters.
- Ensure all prosecution and civil actions referred by the branches are managed efficiently, consistently and in accordance with legal and procedural requirements.
- Review Court decisions that are unfavorable to the Board and prepare reports and recommendations for appeal.
- Handle civil law disputes, whether initiated by or against the EPF Board including contractual and commercial disputes and related claims involving the Board.
- Manages disputes relating to nomination disputes and related claims against the Board.
- Monitor and review the progress of all litigation cases and liaise effectively with panel solicitors to ensure alignment with the case strategy and timeliness.
- Demonstrate agility and adaptability in navigating evolving legal, regulatory and business environments, including emerging risks arising from digitilasation, automation and data driven operations.
- Continuously keep abreast of technological advancements -including Artificial Intelligence (AI) and digital developments, and leverage such tools to enhance legal service delivery, strengthen governance and improve litigation and enforcement outcomes.
- Perform ad-hoc tasks as assigned.
JOB REQUIREMENTS
- Malaysian citizen.
- Pass Malay Language including oral test at Sijil Pelajaran Malaysia (SPM) level or equivalent as recognised by the Government.
- Possess a Bachelor of Laws (Honours) (LLB) or equivalent LLB qualifications from any local or overseas higher learning institutions recognised by the Government of Malaysia.
- Entry‑level positions are open to fresh graduates with strong academic credentials.
- Junior or mid‑level roles are suitable for candidates with 2 - 7 years of relevant legal experience.
- Senior roles are open to legal professionals with 7 - 10 years of relevant legal experience.
- Ability to communicate complex legal concepts and issues clearly and effectively.
- Research abilities to gather relevant legal precedents and information.
- Excellent communication and presentation skills, with strong proficiency in both spoken and written English and Bahasa Melayu.
- Highly motivated and capable of working with minimal supervision.
- Able to work independently as well as collaboratively within a team, with a commitment to meeting tight deadlines.
- Detail-oriented with a focus on accuracy and precision.
- Strong negotiation and problem-solving abilities.
PLACEMENT
Positions are based across the Northern, Southern, Eastern, and Central regions, with offices location in HQ Kwasa Damansara, Alor Setar, Georgetown, Ipoh, Johor Bahru, and Kuantan.
