JOB SUMMARY
To provide legal advice and legal service relating to litigation matters to the management and all departments in the company and to guide them on any legal issues relating to litigation matters, or any other matters assigned by the superior.
KEY DUTIES AND RESPONSIBILITIES
- Assist the Head of Legal Section (HOS) in providing legal advice to all departments, regional offices, and management on general legal and litigation matters to safeguard the company's interests.
- Assist the HOS in drafting and implementing standard operating procedures (SOPs), guidelines, workflows or any necessary documents or forms for legal and litigation matters.
- Oversee, monitor, and advise on litigation and other legal matters as assigned by the HOS and/or Heads of Department (HODs) and/or management.
- Ensure contested litigation is handled properly, promptly, and efficiently by panel solicitors, with effective case management and cost control.
- Ensure contested matters are actively managed to conclusion and identify cases suitable for amicable settlement.
- Instruct external solicitors within the authority granted by the HOS.
- Supervise and mentor Associates and Administrative Assistants.
- Periodically review the performance of external solicitors to ensure the company's interests are protected.
- Prepare and review memos, correspondence, and approval papers related to litigation matters.
- Draft and/or review cause papers, legal opinions, and other relevant documents as required.
- Verify documents prepared by external solicitors and arrange for execution by the relevant parties.
- Conduct legal research, prepare legal opinions, and advise departments, regional offices, management, and the board of directors as required under the direction of the HOS.
- Review evidence and case merits with external counsel for trial matters.
- Coordinate with external counsel and support internal communication and preparation for litigation, arbitration, settlements, and alternative dispute resolution.
- Verify and approve invoices submitted by external solicitors.
- Submit monthly and ad hoc reports to the HOS and/or Head of Department of Corporate Affairs and/or management and board of directors as required.
- Provide legal advice and perform other related duties as assigned by the HOS or Head of Department of Corporate Affairs or the management.
PERSON SPECIFICATION
Minimum Qualifications
- Bachelor of Laws (LLB) (Hons)
- Admitted as an Advocate & Solicitor in the High Court of Malaya
- Minimum of twelve (12) to fifteen (15) years relevant working experience with commensurate skills, knowledge, abilities and quality.
- Experience as practising advocates and solicitor in Malaysia for at least five (5) years.
