Job Overview
The Senior Executive – Procurement & Contract Management will play a pivotal dual role in supporting hyperscale / mission-critical Data Centre (DC) operations in Kulai, Johor. This position is strategically structured as a 50/50 hybrid role combining end-to-end procurement execution with rigorous legal review, contract drafting, and lifecycle management.
The ideal candidate must hold a formal degree in Law (LL.B) and possess hands-on commercial procurement experience in data centre, high-tech engineering, construction, or heavy industrial infrastructure sectors. You will be responsible for safeguarding the organisation's commercial interests, maintaining strict compliance, driving cost efficiency, and managing vendor legal risk across critical operational contracts (M&E, Power, Cooling, Telecoms, SLA management, and Facility Services).
JOB DESCRIPTION (50/50 Work Allocation)
1. Operational Procurement (50%)
- Strategic Sourcing & Tendering: Drive end-to-end procurement activities for DC operational requirements, including HVAC/cooling, high-voltage electrical, UPS systems, generator sets, security, and facilities maintenance.
- RFQ/RFP Management: Prepare, issue, and evaluate Requests for Proposal (RFPs), Tenders, and Quotations. Lead technical and commercial bid evaluations.
- Supplier Evaluation & Onboarding: Conduct vendor risk assessments, financial health checks, and qualification of critical suppliers and contractors.
- Commercial Negotiation: Lead price negotiations, commercial structure discussions, payment terms, and rebate models to maximise cost efficiency.
- Purchase Order Execution: Oversee PO processing and material delivery schedules.
- Supplier Performance (SRM): Monitor vendor KPIs, enforce Service Level Agreements (SLAs), and address operational delivery disputes or under-performance.
- Approval Authority: Operate within delegated procurement spend and contract value approval thresholds as defined in the company's Procurement Policy & Procedure (PPP) matrix.
- Systems & Tools: Utilise the organisation's e-procurement / ERP and Contract Lifecycle Management (CLM) platforms for sourcing, PO issuance, and contract repository management.
2. Contract Drafting & Legal Review (50%)
- Contract Drafting & Customisation: Draft, review, and finalise complex agreements, including Service Level Agreements (SLAs), Non-Disclosure Agreements (NDAs), Master Services Agreements (MSAs), Long-Term Maintenance Agreements (LTMAs), and Equipment Purchasing Contracts.
- Legal & Risk Mitigation: Review terms regarding liability limits, indemnities, warranties, liquidated damages, termination rights, data protection (PDPA), and IP rights to minimise exposure.
- DC SLA Frameworks: Structure strict uptime/availability SLAs, penalty matrixes, and remedy clauses tailored to 24/7 mission-critical data centre requirements.
- Contract Lifecycle Management: Maintain a centralised contract repository, tracking renewals, price escalation formulas, warranty expirations, and contract milestone variations.
- Dispute Resolution: Serve as the primary legal liaison for contract disputes, claims, and default notices with contractors or service providers.
- Regulatory Compliance: Ensure contracts and procurement activities align with applicable local country regulatory requirements, including PDPA, Suruhanjaya Tenaga (Energy Commission) requirements for power/electrical works, local authority (PBT) compliance, and DOSH/environmental requirements where relevant.
- Stakeholder Liaison: Coordinate with internal Finance, Operations, and external legal counsel as needed on high-value or high-risk contracts.
- On-Call / Incident Support: Provide contract and vendor liaison support outside standard business hours in the event of critical operational incidents affecting DC uptime.
JOB REQUIREMENT
1. Education & Professional Qualifications (Mandatory)
Bachelor's Degree in Law (LL. B) from a recognised university is required.
Professional legal qualification (e.g., admission to the local country Bar or Certificate in Legal Practice – CLP) is a strong added advantage.
2. Experience & Knowledge
- Minimum 4 to 6 years of hands-on experience combining legal contract drafting/review and commercial procurement execution.
- At least 2 years focused on contract/legal work and 2 years focused on procurement, to ensure balanced candidate fit for the 50/50 split.
- Proven experience working in Data Centre operations, Telecommunications, Real Estate Development, Energy/Utilities, or Heavy Engineering sectors.
- Demonstrated expertise in drafting and negotiating complex commercial supply contracts, SLAs, and technical service agreements.
- In-depth understanding of local local country contract law, commercial practices, and regulatory frameworks (e.g., Energy Commission, Local Authority compliance).
3. Skills & Competencies
- Legal Drafting Mastery: Ability to draft customised, legally binding clauses without sole reliance on standard boilerplate templates.
- Commercial Acumen: Strong negotiation skills with a deep understanding of cost structures, total cost of ownership (TCO), and market pricing trends in Johor/Malaysia.
- Location & Mobility: Based in or willing to relocate to Kulai, Johor, with flexibility to travel within the region as operational needs require.
- Communication: Fluent in professional written and spoken English and Bahasa Malaysia (Mandarin fluency is a plus for regional vendor interfacing).
- Systems Proficiency: Working knowledge of e-procurement, ERP, and/or contract lifecycle management (CLM) tools.
