ROLE PURPOSE
Conduct and document the assessment for Shariah non-compliance (SNC) events referred by the relevant parties. The role includes performing the assessment, drafting the assessment report, engaging with stakeholders, and presenting the assessment to the BNM Shariah Advisory Council of (SAC). This is done based on a comprehensive Shariah assessment to ensure timely and effective Shariah compliance across all stakeholders as mandated under relevant laws, thereby promoting overall adherence to Shariah requirements. The role also includes formulating policies for SNC assessments to ensure consistency, standardization, and high‑quality assessment practices.
PRINCIPAL ACCOUNTABILITIES
- Conduct Shariah assessment - To conduct Shariah assessment on SNC events referred to the Shariah Specialist, determine the Shariah status of the incidents, and propose the severity level of the incidents based on criteria specified in the Shariah Compliance Enforcement Framework (SCEF).
- Prepare referral documentation - To prepare assessment materials for SNC events requiring referral to the BNM Shariah Advisory Council (SAC), and to assist in the preparation of Enforcement Admission Document (EAD) for presentation to the Enforcement Committee (EC).
- Develop frameworks and manage database - To develop and review related frameworks including the Internal Framework for SNC Assessment and the SCEF, and to maintain SNC database to ensure accuracy and proper documentation.
- Facilitate SNC policy development - To facilitate the research and development of policy for SNC management at the industry level to streamline the practices across regulated entities.
- Prepare periodic reports for oversight - To prepare periodic reports on SNC events for submission to SAC and/or the Bank's management.
- Review implementation of Shariah policies - To review the implementation of Shariah relevant Shariah policies, such as Hajah and Darurah Policy Document, to ensure consistent application across operations.
QUALIFICATIONS
Academic Qualifications:
- Minimum: Bachelor's degree in Shariah (that includes the study of Fiqh, Usul Fiqh and Fiqh Muamalat).
- Advantage: Knowledge in Law, Finance, Economics, Takaful or Accounting.
Experience:
- For Analyst, at least five (5) years of experience in banking and finance.
- For Associate Analyst, at least 2-3 years of experience in banking and finance.
